1. Acceptance of Terms

Welcome to mohawkpacking.com ("Website"). By accessing or using this Website and our packaging manufacturing services, you ("Customer," "you," or "your") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Website or our services.

These Terms apply to all visitors, quote requesters, and customers of Mohawk Packing ("Mohawk," "we," "us," or "our").

2. Services Overview

Mohawk Packing provides custom packaging manufacturing services, including but not limited to:

  • Rigid boxes and folding cartons
  • Specialty paper engineering and custom printing
  • Print finishes (embossing, foil stamping, UV coating)
  • Global logistics and supply chain coordination
  • Technical consulting and material specification

All services are provided on a business-to-business (B2B) basis and are subject to written quotations, purchase orders, and supply agreements.

3. Quotations and Orders

3.1 Quote Requests

Quote requests submitted via the Website or contact forms are non-binding. We will provide formal written quotations based on specifications, quantities, materials, and delivery requirements. Quotations are valid for 30 days unless otherwise specified.

3.2 Order Acceptance

A legally binding contract is formed only upon our written acceptance of your purchase order. We reserve the right to accept or decline any order at our discretion.

3.3 Specifications

Customers are responsible for providing accurate specifications, artwork, and product requirements. Changes after production has commenced may incur additional charges and delay delivery.

3.4 Minimum Order Quantities (MOQ)

Custom packaging orders are subject to MOQs, which vary by product type and complexity. MOQs will be specified in each quotation.

4. Pricing and Payment

4.1 Pricing

All prices are quoted in USD and are subject to change based on material costs, currency fluctuations, and production variables. Final pricing is confirmed in the written quotation and invoice.

4.2 Payment Terms

Standard payment terms are Net 30 days from invoice date for established customers. New customers may be required to pay a deposit (typically 50%) before production begins. We accept wire transfers, ACH, and approved credit terms.

4.3 Late Payment

Overdue invoices are subject to a late fee of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is lower. We reserve the right to suspend services for accounts with outstanding balances.

5. Production and Delivery

5.1 Lead Times

Production lead times are estimates and may vary based on order complexity, material availability, and factory capacity. Lead times are specified in quotations and begin after final artwork approval and deposit receipt.

5.2 Delivery

Unless otherwise agreed, delivery terms are EXW (Ex Works) from our manufacturing facility. Shipping costs, import duties, and customs fees are the Customer's responsibility unless explicitly included in the quotation.

5.3 Delays

Mohawk is not liable for delays caused by force majeure events, including natural disasters, pandemics, labor disputes, material shortages, transportation disruptions, or government actions.

6. Quality Control and Acceptance

6.1 Production Standards

All products are manufactured to industry-standard tolerances. Color matching is approximate and subject to material limitations and production variables. We provide pre-production samples upon request for an additional fee.

6.2 Inspection Period

Customers must inspect delivered goods within 7 business days of receipt and notify us in writing of any defects or non-conformities. Failure to notify within this period constitutes acceptance of the goods.

6.3 Overs and Unders

Manufacturing tolerances of ±10% on ordered quantities are industry-standard and acceptable. Billing will be based on actual quantities delivered.

7. Intellectual Property

7.1 Customer Content

Customers retain ownership of all trademarks, logos, designs, and artwork provided to Mohawk. By submitting content, you grant us a non-exclusive license to use, reproduce, and modify materials solely for fulfilling your orders.

7.2 Mohawk Property

Mohawk retains ownership of all proprietary manufacturing processes, technical documentation, and company materials. Website content, including text, graphics, and code, is protected by copyright and may not be reproduced without permission.

7.3 Tooling and Dies

Custom tooling, dies, and printing plates remain Mohawk property unless otherwise agreed in writing. Customers may purchase tooling ownership for an additional fee.

8. Warranties and Disclaimers

8.1 Limited Warranty

Mohawk warrants that products will conform to agreed specifications and be free from material defects in workmanship. Our sole obligation under this warranty is to replace or credit defective products reported within the inspection period.

8.2 Disclaimer

EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOHAWK'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM PRODUCTS OR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL MOHAWK BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Confidentiality

Both parties agree to maintain confidentiality of proprietary information, including pricing, specifications, and business strategies. This obligation survives termination of any agreement for 3 years.

11. Cancellations and Returns

11.1 Cancellations

Orders may be cancelled only before production begins. Cancellation after production commencement will incur charges for completed work, materials, and tooling costs.

11.2 Returns

Custom-manufactured products are non-returnable except for defects covered under our warranty. Return authorization must be obtained in writing before shipping any goods back to Mohawk.

12. Website Use

12.1 Permitted Use

The Website is intended for lawful business purposes only. You may not use the Website to transmit harmful code, spam, or engage in fraudulent activities.

12.2 Accuracy

While we strive for accuracy, information on the Website (including pricing, specifications, and availability) is subject to change without notice. We reserve the right to correct errors and update content.

13. Governing Law and Dispute Resolution
